1. Purpose and scope of the Policy

Audencia attaches the utmost importance and care to the protection of privacy and Personal Data, as well as to compliance with the provisions of the applicable Legislation. 
The Regulation (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the Processing of Personal Data and on the free movement of such Data (hereinafter "RGPD") affirms that Personal Data must be processed lawfully, fairly, and transparently. Thus, this privacy policy (hereinafter the "Policy") aims to provide you with simple, clear information on the Processing of Personal Data concerning you, in the context of your browsing and operations carried out on our website.

2. Data Processor

As part of your activity on the Audencia.com website, we collect and use, Personal Data in connection with you, individuals (hereinafter "Data Subject"). 
For all processing, Audencia is the entity that determines the means and purposes and thus acts as the Data Controller within the meaning of the applicable regulations on personal data and in particular EU Regulation 2016/679 on the protection of individuals with regard to the Processing of Personal Data and on the free movement of such Data (hereinafter "RGPD").

Your Personal Data is processed by AUDENCIA, Etablissement public national d'enseignement, an institution of higher education with capital of €30,900,000.00, whose registered office is located at 8 Route de la Jonelière - B.P. 31222 - 44312 Nantes Cedex 3, registered in the Nantes Trade and Companies Register under number 834 748 865. Its Chairman is Laurent Métral.
 

3. Information on Personal Data processed, purposes and basis of processing, retention periods

3.a What personal data do we collect and how?

By using our website, you transmit to us a certain amount of information about yourself, some of which is likely to identify you ("Personal Data"). This is the case when you browse our site, when you fill in online forms. 
The nature and quality of the Personal Data collected about you will vary depending on your relationship with Audencia. The personal data we collect is referenced in the table that can be consulted in the last sub-section of this §3 "d. Table summarizing the processing of personal data.

Each form on the site limits the collection of Personal Data to that which is strictly necessary and indicates the purpose(s) for which the Data is collected. 
The Data essential to the management of your request are indicated by an asterisk on each form. If you do not fill in these mandatory fields, Audencia will not be able to respond to your requests and/or provide you with the requested services. Other information is optional and allows us to better manage your request and improve our communications and services to you. 
 

3.b Why do we collect your Personal Data and how?

We collect your Personal Data for specific purposes and on different legal grounds. These are referenced in the table that can be consulted in the last sub-section of this §3 "d. Among these purposes is that of carrying out commercial prospecting operations. We inform you that if you have given your consent to the processing of your data for commercial canvassing purposes, you have the possibility of withdrawing it at any time via an unsubscribe link affixed to the end of the canvassing message received. We also inform you that if you have not objected to receiving commercial offers for products or services offered by Audencia and similar to those you have already purchased, you may do so later via the unsubscribe link at the end of the prospecting message received. Audencia uses profiling to offer services in line with the wishes of prospective customers. The consequences for the person concerned are as follows:
- receipt of personalized emails
- receipt of personalized SMS messages."

3.c How long do we keep your personal data?

We keep your Personal Data only for as long as is necessary to fulfill the purpose for which we hold the Data, and this is to meet your needs or to fulfill our legal obligations. Retention periods vary depending on several factors, such as:

  • The needs of Audencia's business;
  • Contractual requirements;
  • Legal obligations;
  • Recommendations from supervisory authorities.

5. Do we share your personal Data?

Your Data is intended for authorized Audencia employees in charge of managing and executing contracts and legal obligations, according to the purposes of collection and within the limits of their respective attributions. It may be transmitted to the following recipients for certain tasks related to the purposes, and within the limits of their respective missions and authorizations:

  • Internal recipients (Marketing Department; IT Department, Sales Department);
  • Subcontractors we call upon to carry out a range of operations and tasks, on our behalf in particular;
  • Business partners only when you have expressly consented to this via the advertising and/or social network cookie acceptance button;
  • Persons or bodies able to obtain the communication of data by virtue of a legislative or regulatory provision.

We do not sell your Data.

6. Are your Personal Data transferred to Third Countries?

Audencia endeavors to keep Personal Data in France, or at least within the European Economic Area (EEA). However, it is possible that the Data we collect when you use our platform or as part of our services may be transferred to other countries. This is the case, for example, if some of our service providers are located outside the European Economic Area. In the event of a Transfer of this type, we guarantee that it is carried out:

  • To a country ensuring an adequate level of protection, i.e. a level of protection equivalent to what European Regulations require;
  • Under standard contractual clauses;
  • Under internal company rules.

7. How long do we retain your Personal Data?

8. How do we ensure the security of your Personal Data?

Audencia is committed to protecting the Personal Data we collect, or what we process, from loss, destruction, alteration, unauthorized access or disclosure. 
As such, we implement all appropriate technical and organizational measures, depending on the nature of the Data and the risks that their Processing entails. These measures must preserve the security and confidentiality of your Personal Data. They may include practices such as restricted access to Personal Data by authorized persons, by virtue of their functions, pseudonymization or encryption. 
In addition, our practices and policies and/or physical and/or logical security measures (secure access, authentication process, backup copy, software, etc) are regularly checked and updated if necessary.

9. What are your rights?

The RGPD provides Data Subjects with rights that they can exercise. These include:

  • Right of access (to check the accuracy of data concerning them)
  • Right of rectification (to correct erroneous data or complete certain information)
  • Right to erasure (to avert the risk of an individual being permanently affected by a reference concerning them, whether this is present online as a result of their own doing or that of a third party).
  • Right to limitation of processing (prohibit the use of certain data during the period of examination of the request made)
  • Right to portability (recovery of data for personal use or to transmit them to another online service that may offer new services, or to change platforms while retaining the existing history)
  • Right of opposition (to object at any time, for reasons relating to his or her particular situation, to the processing of his or her data for canvassing purposes and profiling linked to such canvassing).

To this end, Audencia has implemented a procedure for managing People's rights that complies with the requirements of the applicable Legislation. This procedure establishes:

  • The standards to be met to ensure transparent information for the Persons concerned;
  • The legal requirements that must be complied with;
  • The authorized means of submitting a request for each right, depending on the category of Persons concerned;
  • The operational processes for handling these requests in accordance with the above requirements;
  • The parties involved in these processes, their roles and responsibilities.

When you send us a request to exercise a Right, you are asked to specify as far as possible the scope of the request, the type of right exercised, the Personal Data Processing concerned, and any other useful element, in order to facilitate the examination of your request. In addition, in case of reasonable doubt, you may be asked to provide proof of your identity.

You also have the right to refer to the Commission Nationale de l'Informatique et des Libertés (CNIL), 3 Place de Fontenoy - TSA 80715 - 75334 PARIS CEDEX 07, any complaint relating to the way Audencia collects and processes your data.

10. Updating of this Policy

This Policy may be updated on a regular basis in order to take into account changes in the Regulations relating to Personal Data.
